American R&B singer Chris Brown has avoided immediate imprisonment after a UK court sentenced him to eight months in prison, suspended for 12 months, over a bottle attack on music producer Abraham Diaw at a London nightclub in February 2023.

The 37-year-old singer was sentenced at Southwark Crown Court on Monday, October 26, after pleading guilty to affray in connection with the incident at Tape nightclub in Mayfair, central London.

The suspended sentence means Brown will not serve the prison term immediately, provided he complies with the applicable conditions and does not trigger the sentence under the law during the suspension period.

Court proceedings established that Brown struck Diaw, a former friend, with a tequila bottle during the nightclub confrontation. Video footage presented in court showed the singer hitting the producer in the head.

Judge Tony Baumgartner described the use of a glass bottle against someone’s head as dangerous, noting the potential for more serious injuries.

Despite the seriousness of the incident, the judge considered mitigating circumstances, including Brown’s guilty plea, employment and charitable activities, when determining the sentence.

Brown had faced the possibility of a longer prison term before prosecutors accepted his guilty plea to affray. Charges relating to assault, attempted grievous bodily harm and possession of an offensive weapon were dropped as part of the resolution of the case.

Brown’s friend and vocal coach, Omololu Akinlolu, who was also involved in the confrontation, received a four-month prison sentence suspended for 12 months. Both men were also ordered to pay £1,500 in costs, according to reports from the court proceedings.

The case attracted considerable attention because of Brown’s international music career and his previous legal troubles. The singer has remained a prominent figure in contemporary R&B, with a career spanning music releases, tours and live performances.

The incident itself occurred more than three years before sentencing, but the court proceedings brought renewed attention to the circumstances surrounding the nightclub confrontation.

The suspended sentence does not amount to an acquittal. Brown pleaded guilty to the offence and was formally sentenced, although immediate imprisonment was not imposed.

The ruling highlights the distinction between a custodial sentence and a suspended prison term under the English legal system.

Brown’s legal team had the opportunity to present mitigating circumstances, while the court considered the seriousness of the offence and the circumstances of the defendant before deciding on the sentence.
